1. Acceptance of Terms

By creating an account on lucidping.com ("the Platform," "we," "us," or "our") and clicking "I agree," you enter into a binding legal agreement with us and confirm you are at least 16 years of age. If you do not agree, you may not use the Platform.

2. Description of Service

lucidping.com is a remote startup and opportunity marketplace that connects founders with contributors, developers, designers, and other professionals. We provide:

• A platform for listing and discovering startup, project, and collaboration opportunities.
• Application and recruitment tools for managing candidates.
• Profile and portfolio pages for contributors to showcase their work.
• Communication tools including notifications and invite systems.

3. User Accounts

You are responsible for maintaining the security of your account credentials. You must not share your password, use another person's account, or create accounts for others without their explicit permission. You agree to notify us immediately of any unauthorised use of your account.

You may only create one account per person. Duplicate, fake, or bot accounts are prohibited and may be removed without notice.

4. Acceptable Use

You agree not to use the Platform to:

• Post fraudulent, misleading, or deceptive listings.
• Harvest or scrape user data, email addresses, or profile information.
• Send unsolicited commercial communications (spam).
• Impersonate any person, company, or legal entity.
• Circumvent security measures, rate limits, or access controls.
• Upload malicious code, viruses, or any content designed to disrupt the service.
• Discriminate against applicants on the basis of protected characteristics.
• Post content that is defamatory, threatening, or violates any applicable law.

5. Listings and Content

You retain ownership of content you post on the Platform. By posting, you grant us a non-exclusive, worldwide, royalty-free licence to display, distribute, and promote your content within the Platform. We do not claim ownership of your intellectual property.

You are solely responsible for the accuracy and legality of your listings. We reserve the right to remove listings that violate these Terms without prior notice.

6. Applications and Hiring

The Platform facilitates introductions between founders and contributors. We are not party to any employment, contracting, or collaboration agreements made through the Platform. Any such agreements are solely between the parties involved.

We do not guarantee that listings will result in a hire, nor that applications will receive a response.

7. Services Marketplace

Members who purchase Seller Access may publish a service listing ("Service") describing work they offer, and other members ("Buyers") may contact them through the Platform. We are a venue only. lucidping.com is not a party to, and does not broker, mediate, escrow, invoice, or guarantee, any agreement between a Seller and a Buyer.

• No commission. We take no percentage, fee, or cut of any amount a Seller and Buyer agree between themselves. The only amounts we charge are the Seller Access fee and optional promotion credits, which are paid to us for use of the Platform and not for any individual engagement.
• Payment and delivery happen off-platform. Pricing, scope, deadlines, payment method, invoicing, taxes, refunds, and delivery of work are agreed and handled directly between the Seller and the Buyer. We do not hold funds, process payment between members, or verify that payment or delivery has occurred.
• No guarantees. We do not guarantee the quality, safety, legality, or timeliness of any Service, the accuracy of any listing, the identity or qualifications of any Seller, or the ability of any Buyer to pay. "Verified" indicates only that a Seller has passed our internal listing review; it is not an endorsement or a warranty.
• Disputes. Any dispute arising from a Service engagement is solely between the Seller and the Buyer. You release us from claims, demands, and damages of every kind arising out of or connected with such disputes, to the extent permitted by law.
• Reports and strikes. A Buyer may report a Seller, and a Seller may report a Buyer, through the Platform's report form. Our staff review each report and may uphold or dismiss it at our sole discretion; a review is not an adjudication of the underlying dispute and creates no obligation on us. An upheld report is recorded as a strike against the reported account. Two upheld strikes suspend a Seller's listing (it is hidden and marked "under review" and cannot receive requests) or, for a Buyer, remove the ability to send requests, leave reviews, or file further reports. We may also suspend or restrict any account immediately, without waiting for a second report, where we consider the conduct to be fraud, abuse, or a risk to other members. A report that our staff find to be knowingly false or malicious is a strike against the account that filed it. Suspension of Seller Access for these reasons is without refund. Reports and their contents are confidential to our staff; the reported party is told the outcome and the reason, never the identity of the reporter.
• Seller obligations. Sellers are responsible for their own tax, licensing, and legal compliance in their jurisdiction, for honouring what their listing promises, and for keeping their availability status accurate. Only one Service per account may be published.
• Reviews. Reviews may only be left by a member who contacted the Seller through the Platform. Reviews must reflect a genuine experience. We may hide or remove reviews and suspend or reset the ratings of any account where we detect reciprocal, purchased, self-authored, or otherwise manipulated reviews, and may revoke that account's verified status and Seller Access without refund.
• Seller Access fees. Seller Access is billed monthly, annually, or as a one-time lifetime payment and is separate from Contributor Pro and Founder Pro. Member discounts on Seller Access are re-evaluated at each renewal based on your subscription at that time. Seller Access does not entitle you to any minimum number of requests, views, or engagements.

8. Subscriptions and Payments

Paid features are available through Contributor Pro and Founder Pro subscriptions and Seller Access, billed monthly, annually, or as a one-time lifetime payment. Promotion credits ("coins") are a one-time purchase, are not redeemable for cash, and are consumed when spent. Payments are processed by Stripe. By subscribing, you authorise us to charge your payment method on the applicable billing cycle.

Subscriptions auto-renew unless cancelled before the renewal date. Lifetime plans are a one-time payment with no recurring charges. We do not offer refunds for partial billing periods, except where required by law.

9. Termination

We may suspend or terminate your account at any time for material violation of these Terms. You may delete your account at any time via your account settings. Upon deletion, your data is permanently removed per our data retention policy in the Privacy Policy.

10. Limitation of Liability

To the maximum extent permitted by law, lucidping.com shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from these Terms shall not exceed the amount you paid us in the twelve months preceding the claim.

11. Governing Law

These Terms are governed by applicable law. Any disputes shall be resolved through binding arbitration or in the courts of the jurisdiction where we are incorporated, unless otherwise required by consumer protection law in your country.

12. Changes to Terms

We may update these Terms from time to time. When we do, the version number and effective date will change. We will notify you within the Platform and require re-acceptance if the changes are material. Continued use after the grace period constitutes acceptance.

lucidping.com operates at https://lucidping.com. We are the data controller for the personal data you provide to us. Contact: nelsonnjie@gmail.com

2. What Data We Collect

We collect the following categories of personal data:

• Account data: Your email address, display name, and hashed password.
• Profile data: Headline, bio, location, skills, availability, links, avatar, and portfolio items you choose to provide.
• Activity data: Listings you post, applications you submit, listings you follow or save, invites sent and received, notifications.
• Payment data: Subscription plan type, billing dates, and Stripe customer ID. We do not store card numbers — these are held by Stripe.
• Technical data: IP address (hashed for analytics), browser type, and access logs retained by WordPress.
• Communications: Messages you send through the invite system, service requests you send to Sellers, and any support enquiries.
• Services data: If you purchase Seller Access: your service listing, packages, availability status, last-active time, region and languages, verification documents you submit, and reviews you receive. If you leave a review: the review text, rating, and your IP address (retained to detect manipulated reviews).

3. How We Use Your Data

We use your personal data to:

• Provide and maintain the Platform and your account.
• Display your profile to other users as you configure it.
• Send transactional emails (application updates, invite notifications, listing updates you've subscribed to).
• Process subscription payments via Stripe.
• Improve the Platform through aggregated, anonymised analytics.
• Comply with legal obligations.

We do not sell your personal data to third parties. We do not use your data for automated decision-making that has legal or similarly significant effects.

4. Legal Basis for Processing (GDPR)

If you are in the European Economic Area or UK, our legal bases are:

• Contract: Processing necessary to provide you the service you've signed up for.
• Legitimate interests: Security, fraud prevention, and platform improvement.
• Consent: Marketing emails and optional analytics. You may withdraw consent at any time.
• Legal obligation: Where required by law.

5. Data Sharing

We share data only with:

• Stripe: For payment processing. Stripe's privacy policy applies to payment data.
• Email service provider: For transactional email delivery. Emails contain only what is necessary.
• Other users: Your profile data is visible according to your privacy settings. Founders can see your profile if you opt in to the talent directory. When you send a service request, your name, email address, and message are delivered to that Seller so they can reply to you directly; anything you then agree with the Seller happens outside the Platform and is not covered by this policy.
• Law enforcement: When required by valid legal process.

6. Data Retention

We retain your personal data for as long as your account is active. When you delete your account, all your personal data is permanently erased within 30 days, except where we are required by law to retain certain records (e.g. billing records for tax purposes, retained for 7 years).

7. Your Rights

Depending on your location, you have the right to:

• Access: Request a copy of all data we hold about you.
• Rectification: Correct inaccurate personal data.
• Erasure: Request deletion of your data ("right to be forgotten").
• Portability: Receive your data in a machine-readable format.
• Restriction: Request we limit processing of your data.
• Objection: Object to processing based on legitimate interests.
• Opt-out (CCPA): California residents may opt out of the "sale" of personal information. We do not sell personal data.

8. Cookies

We use essential cookies for session management (WordPress authentication) and a CSRF nonce cookie. We do not use tracking, advertising, or third-party analytics cookies. You may disable cookies in your browser but this will prevent you from logging in.

9. Data Security

We implement industry-standard security measures including password hashing (bcrypt via WordPress), HTTPS-only access, CSRF nonce protection on all forms, rate limiting on authentication endpoints, HMAC-signed tokens for email verification and unsubscribe links, and Stripe's PCI-compliant payment infrastructure.

No method of transmission over the internet is 100% secure. We cannot guarantee absolute security but commit to disclosing any breach affecting your personal data within 72 hours of discovery, as required by GDPR Article 33.

10. Children

The Platform is not directed at children under 16. We do not knowingly collect data from anyone under 16. If we discover we have done so, we will delete it immediately.

11. Changes to This Policy

We may update this Privacy Policy. The version number and effective date at the top will change. Material changes will be notified within the Platform and may require re-acceptance.
